MANDATORY ENERGY AUDIT FOR LARGE ENTERPRISES (every 4 years)
Mandatory Energy Audits are implemented on the basis of the Act of May 26, 2016 on Energy Efficiency, which says that every large enterprise (employment of 250 people and/or annual turnover of EUR 50 million and/or exceeding annual balance sheet total of 43 million euros in the last 2 financial years) is obliged to conduct an Energy Audit every 4 years.
The main objective of the audit of large enterprise is to obtain knowledge about the energy consumption for a given building or group of buildings/industrial or commercial installation/services, means of transport and to forecast the possible manner and amount of achieving cost-effective energy savings. The mandatory audit also applies to transport companies.
Each energy audit must be carried out in accordance with the formal requirements set out in the Directive 2012/27/EU - "Minimum criteria for energy audits including those carried out as part of energy management systems". The audit is carried out on the basis of current and verifiable data related to the energy consumed and the company's energy needs . It should present a list of energy consumed with division into specific sets of premises and individual buildings; determine a minimum of 90% of the total energy consumption in enterprises; it should be based on the cost analysis of the life cycle of the building and group of buildings presented in it, which will allow to take into account long-term savings.
Energy audit should be carried out every 4 years. From the moment of the introduction of the regulations, the legislator provided for its implementation only 12 months from the date of entry into force of the Act of 20 May 2016, that is from 30 September 2016. This means that in order to carry out the audit, the companies will have time had until 30 September 2017. However, due to the development of the economy and, hence, enterprises, every "new", the so-called big entrepreneur - after obtaining the relevant information (checking the financial and employment criterion for the last two financial years) - is an entity obliged to conduct an energy audit of an enterprise in order to fulfil its duty and provide the President of the ERO with a notification about the audit.
The audit ends with the issuance of a report that should be submitted to the Energy Regulatory Office by 3 October, the year in which the company is obliged to carry out such an audit. The failure to carry out an energy audit of the company shall be subject to fines. The penalty may amount to up to 5% of the annual revenue of the punished entrepreneur in the financial year preceding the year of imposing the fine.
If the company's energy audit was carried out in 2017, according to the current regulations, the next one should be carried out in 2021.

AUDITS OF BUILDINGS FOR THE CERTIFICATE OF ENERGY EFFICIENCY OF BUILDINGS briefly ENERGY CERTIFICATES (every 10 years)
Pursuant to the applicable law, the property owners or managers who want to sell or rent it are required to commission the preparation of energy performance certificate. In other words, all companies (eg Panattoni, Pro Logis, companies from the BTS sector etc.), dealing with the logistics, production or commercial space lease should have energy performance certificates for the leased space.
Energy performance certificates for buildings have been in force since 2009 in Poland and determine the total energy demand necessary for the use of a building or its part. They take into account the technical parameters of the structure and installation as well as the heat sources. The owner, buyer or new user can check how much the estimated operating costs of a building, warehouse, house or flat.

The energy certificate informs us first of all about the quality of the building in terms of energy consumption. The level of energy use is influenced by many factors - from the materials used, through the type of construction to the efficiency of the installation. These elements together determine the amount of costs related to the operation of a given building or premises, so real estate buyers gain a great tool in finding the best offer for themselves.
The energy certificate is valid 10 years from the date of its preparation. In case of thermo-modernization or renovation, when the characteristics of the premises change (e.g. by replacing windows, a boiler or a heating installation), the energy performance certificate should be prepared again. This is the responsibility of the investor or a building owner.

Thanks to to the technical potential, we are able to carry out such audits in a relatively short time, which at the stage of the premises being offered for sale or already during their actual sale can be of real significance. In addition, it does not matter to us in which part of the country the premises are located, due to the mobility of our auditors.
